WHAT IS CONVEYANCING?

Conveyancing is the term used to describe the legal and adminstrative work carried out when transfering the ownership of buildings or land from one owner to another. Only when an offer has been made and accepted for a property, and both parties solicitors' details have been exchanged can the conveyancing process begin.

WHO WILL CARRY OUT THE CONVEYANCING?

A named, fully qualified and Solicitor or Licensed Conveyancer at A. D. Varley & Co Solicitors a specialist conveyancing practice. (For more information visit advarleyandco.co.uk )

They will keep you advised throughout your transaction and will send you copy documents for information where appropriate. On a purchase, when you are ready to sign the contract, you will be sent not only the contract and other documents to sign but also a report on the property you are buying.

MUST EVERYTHING BE DONE ONLINE?

No. Once you have instructed A. D. Varley & Co you can call into the office, telephone or write to the Solicitor acting for you as well as e-mail. Although A. D. Varley & Co will reply to e-mails, by the nature of the conveyancing process most of the communication from them to you will be by ordinary mail.

HOW LONG WILL IT TAKE?

If you are buying an empty house and you have no sale then the speed of the transaction will only depend on how quickly you can get your mortgage and how quickly information is supplied by the other side. As soon as you have a chain, the speed will also depend on the same factors for every party in the chain, and the whole chain will only be as quick as the slowest of them.

As a guideline we would suggest that you expect a period of 6-8 weeks.

WILL THERE BE ANY EXTRA FEES?

A. D. Varley & Co Solicitors will charge the fixed fee contained in the quote. Unlike some firms they do not charge extra for indemnity insurance or for filling in the Stamp Duty form, which in some cases can be as much as £50.

On a purchase however you will have to pay a local authority search fee, which varies between local authorities (average approximately £120). If you are buying in a mining area you will have to pay £24 for a mining search. If you are buying a new property the builders will make a charge for providing their documents and if you are buying a flat, the landlord’s agents will probably make a charge for providing information. This list is not exhaustive.

Please remember that these fees are all payable to other organisations. They are not part of your legal fees and are payable whichever firm does your conveyancing.
